Welcome to PublicSeek. Before you dive in, please take a moment to review these Terms of Service. By using PublicSeek.org, you're agreeing to these terms, so it's important that you understand them. If anything doesn't sit right with you, we'd prefer you not use the service rather than proceed uncomfortably.

The Agreement

These Terms of Service, together with our Privacy Policy, form a binding agreement between you and PublicSeek. This agreement covers your access to our website, your use of our background information services, and any membership plans you purchase. We're willing to provide these services only if you accept these terms in full.

Important: This Agreement Contains Arbitration Terms

By using PublicSeek, you agree to resolve disputes through binding arbitration rather than in court, and you waive your right to participate in class action lawsuits. Please review the Dispute Resolution section carefully.

Who Can Use PublicSeek

You must be at least 18 years old to use PublicSeek. When you provide information to us, it needs to be accurate and truthful. If we discover false information, we reserve the right to terminate your access immediately and cancel any pending transactions.

What PublicSeek Is (And Isn't)

PublicSeek provides access to public records and publicly available information for informational purposes. Here's what's crucial to understand:

PublicSeek is NOT a Consumer Reporting Agency

We are not covered by the Fair Credit Reporting Act (FCRA). This means the additional protections that apply to consumer reports don't apply here. You cannot use information from PublicSeek for employment screening, credit decisions, housing applications, insurance eligibility, or any other FCRA-regulated purpose.

How You Can Use Our Service

When you purchase a membership, you get a limited license to use our background information services for your own personal, non-commercial purposes. That's it—simple and straightforward.

You may NOT use PublicSeek to:

  • Make employment, credit, insurance, or housing decisions
  • Harm, harass, stalk, or threaten anyone
  • Seek information about minors (anyone under 18)
  • Look up celebrities, government officials, or election candidates
  • Resell or broker the information to others
  • Use the service for any commercial purpose
  • Create a competing product or service

Membership Plans & Billing

We offer several membership plans with different billing cycles. When you sign up for a membership, here's what happens:

  • Your membership automatically renews at the end of each billing period
  • We'll charge the payment method you provided
  • You won't receive additional authorization requests for recurring charges
  • You can cancel anytime before your next billing date

To cancel, simply call us or log into your account dashboard. Our customer support line is available Monday through Friday, and online cancellation is available 24/7.

Accuracy & Disclaimers

Let's be honest: public records aren't perfect, and neither are the reports we generate from them. Information may be outdated, incomplete, or contain errors. We provide the service "as is" without guaranteeing accuracy. Always independently verify important information before relying on it.

We limit our liability to the amount you've paid us in the past six months, or $50, whichever is greater. We're not responsible for decisions you make based on information from our service.

Dispute Resolution

If we have a dispute, we both agree to try resolving it through arbitration rather than going to court. Here's how it works:

  1. Negotiate First: Before arbitration, we'll try to work it out directly. You'll send us written notice of the dispute, and we'll have 30 days to respond and attempt a resolution.
  2. Individual Arbitration: If negotiation doesn't work, disputes go to binding arbitration on an individual basis—no class actions.
  3. Location & Costs: Arbitration takes place in your state capital (or can be done by phone). We'll cover arbitration costs if they would otherwise be prohibitive.
  4. Small Claims Exception: You can still take disputes to small claims court if they qualify.

Want to Opt Out of Arbitration?

You can opt out by sending written notice within 30 days of first using PublicSeek. Your opt-out notice must include your name, address, phone number, email, and signature. Send it to the contact address listed at the bottom of this page.

Your Responsibilities

You're responsible for keeping your account credentials secure and for all activity that occurs under your account. Don't share your password. If you think your account has been compromised, contact us immediately.

Changes to These Terms

We may update these Terms from time to time. When we do, we'll post the updated version here with a new "Last Updated" date. Continued use of PublicSeek after changes means you accept the new terms.
